U.S. Supreme Court Rules in Favor of GRC Client Michael Nance

On June 23, 2022, the U.S. Supreme Court ruled in favor of GRC client Michael Nance, who had challenged the constitutionality of his execution by lethal injection, in light of his unique medical conditions. In proceedings below, the Eleventh Circuit Court of Appeals had held that Mr. Nance could not bring his claim in a federal civil rights action, but that he should have brought his claim in habeas proceedings instead – effectively closing the courthouse doors for him. The U.S. Supreme Court agreed with Mr. Nance that he could bring his claim in the civil rights action. GRC was proud to partner with the law firm Jenner & Block, which took the case pro bono, in the Supreme Court. The Court’s opinion is available here.
